Enforcement Services and Fees

The bailiff’s fee is established by mutual agreement, in accordance with the law that provides the minimum and maximum fees for services provided by bailiffs.

The National Union of Bailiffs establishes and, with the approval of the Minister of Justice, updates the minimum  and maximum fees for services provided by bailiffs.

The Order No 2550/2006 issued by the Ministry of Justice establishes the following minimum and maximum charges for the services rendered:

Transmission of the procedural documents

Notification and transmission of the procedural documents: RON 20 – 400

These documents can be transmitted by postmail or by the bailiff’s procedural agent. The notifier must fill in a request for notice and must conceive the notice in three copies (one will remain at the bailiff, one goes to the person that is notified and one returns to the notifier, having the bailiff stamp on it).

Direct enforcement

  • evictions: RON 150 – 2 200 for natural person and RON 5 200 for legal person;
  • awarding custody of or establishing the domicile of a minor: RON 50 – 1 000;
  • visit of minor: RON 50 – 500;
  • conferring possession, delimiting property boundaries, easements, delivery of goods, etc.: RON 60 – 2 200 for natural person and RON 5 200 for legal person;
  • the demolition of buildings: RON 150 – 2 200 for natural person and RON 5 200 for legal person.

Indirect enforcement

  • Enforcement of movable assets:
    • RON 60 for debts up to RON 1 000;
    • RON 60 plus 2% of any amount in excess of RON 1 000;
    • for amounts smaller than RON 50 000, the fee may not exceed 10%;
    • for the amounts between RON 50 001 and RON 80 000, the fee is 3%;
    • for amounts between RON 80 001 and RON 100 000 the fee is 2%;
    • for amounts that exceed RON 100 000 the fee is 1%.
  • Enforcement of immovable assets:
    • RON 150 for debts up to RON 1 000;
    • RON 150 for debts up to RON 1 000 plus 2% of any amount in excess of RON 1 000;
    • for amounts smaller than RON 50 000, the fee may not exceed 10%;
    • for the amounts between RON 50 001 and RON 80 000, the fee is 3%;
    • for amounts between RON 80 001 and RON 100 000RON the feee is 2%;
    • for amounts in excess of RON 100 000 the fee is 1%.

Attachment of earnings

  • RON 60 for debts up to RON 1 000;
  • RON 60 plus 2% of any amount in excess of RON 1 000;
  • for amounts smaller than RON 50 000, the fee may not exceed 10%;
  • 3% for amounts between RON 50 001 and RON 80 000;
  • 2% for amounts between RON 80 001 and RON 100 000;
  • 1% for amounts in excess of RON 100 000.

Other Enforcement Services

  • Protest of non-payment of bills of exchange, promissory notes and cheques: RON 150 – 400
  • Acknowledgement of de facto situations and the the inventory of assets: RON 100 – 2 200 is the fee for natural persons and RON 5 200 for legal persons
  • Sale at public auction of assets derived from judicial division: the fee is between RON 150 – 2 200
  • Distraint upon property: RON 100 – 1 200 for natural persons and RON 2 200 for legal persons
  • Judicial seizure: RON 100 – 1 200 for natural persons and RON 2 200 for legal persons
  • Precautionary attachment: RON 100 – 1 200 for natural persons and RON 2 200 for legal persons
  • Registration of an offer: RON 50 – 350
  • Any other acts or operations required by law: RON 50 – 200
  • Confiscations: 10% of the value achieved (minimal fee) – 10% of the value achieved (maximal fee)
  • Instructions and guidance regarding the use of enforcement measures: RON 20 – 200.
